Your personal data (hereinafter only referred to as "data") will be processed by the operator of the platform GLOBEGURU (hereinafter also referred to as "we") only within the framework of necessity and for the purpose of providing a functional and user-friendly website including the contents and the services offered there.  

 

With the following data protection declaration we inform you in particular about type, extent, purpose, duration and legal basis of the processing of personal data, as far as we decide either alone or together with others about the purposes and means of the processing. In addition, we will inform you below about the third-party components used by us for optimisation purposes and to increase the quality of use, insofar as other providers process data on their own responsibility as a result.

2. data processing of personal data

Personal data within the meaning of the European Data Protection Basic Regulation (DS-GVO) is all information relating to an identified or at least identifiable natural person. This can be the name, address, e-mail address, or IP address of the device or connection with which you use the website.  

 

Your data processed when you use our website will be deleted or blocked as soon as the purpose of storage no longer applies, there are no statutory storage obligations to prevent the data from being deleted and no other processing information is subsequently provided.

For technical reasons, e.g. to ensure a secure and stable website, data is transmitted to us or to our server operator via your Internet browser. With these so-called server log files, among other things, the type and version of your Internet browser, the operating system, the website from which you switched to our Internet presence (a so-called referrer URL), the website of our Internet presence which you access from our servers, the date and time of the respective access and the IP address of the Internet connection from which the use of our Internet presence takes place, are collected.

 

This data is stored temporarily, but not together with other data from you.  

This data is processed anonymously in connection with activities on the website (page views, notepad entry, search terms entered, enquiries, forwarding to external websites, parts thereof) and made available for statistical purposes to the respective partner companies represented on the pages. The partner companies are not able to draw conclusions about specific persons or users. 

This storage takes place on the legal basis of Art. 6 Para. 1 lit. f) DS-GVO. Our legitimate interest lies in the improvement, stability, functionality and security of our Internet presence.

 

The data will be deleted after 30 days at the latest, as far as no further storage is necessary for evidence purposes. Otherwise, the data will be completely or partially excluded from deletion until a final clarification of an incident and will be marked accordingly with a blocking notice (Art. 4 No. 4 DS-GVO).

4. user account

As soon as you wish to create a user account for the platform and request deals, the data required by you during registration or deal enquiry (name, e-mail address and your IP address, identification/profile name for Instagram) will be collected and stored exclusively for pre-contractual services, for contract fulfilment in accordance with the agreed terms of use or for customer care purposes (e.g. to provide you with an overview of your previous enquiries to us). At the same time, we save the IP address and the date of your registration together with the time. An existing user account at Instagram is sufficient to log in to GLOBEGURU. Instagram is an Internet service provided by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. In the EU, these services are operated by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.  

By certifying Facebook to the EU-US Privacy Shield ("EU-US Privacy Shield" International Agreement, https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active ) the provider undertakes to ensure that the level of data protection in the EU is also maintained when data is processed in the USA.  

GLOBEGURU can log the user in after a one-time activation and connection with his Instagram profile.  

Simply enter your Instagram profile name and log in to Instagram using an Instagram API. Instagram will then ask the user for the appropriate permissions required for the link. The information Instagram provides to us includes:

Since the login is done via Instagram, login information for Instagram is not communicated to GLOBEGURU.  

A later login to GLOBEGURU only requires a login to Instagram. The user is assigned via the sections. The data transmitted to GLOBEGURU by Instagram are stored exclusively on servers within Germany. During the registration process via Instagram, consent will be obtained for this processing and reference will be made to this privacy statement. The data collected by us will be used exclusively for providing the user account and, if necessary, for billing and communication purposes with the user. If you consent to this processing within the scope of registration, Art. 6 Para. 1 lit. a) DS-GVO is the legal basis for the processing.  

If the initial registration of the user account also serves pre-contractual purposes, the legal basis for this processing is also Art. 6 para. 1 lit. b) DS-GVO.

Pursuant to Art. 7 (3) DS-GVO, you may revoke your consent to the creation and maintenance of the user account at any time with effect for the future. All you have to do is inform us of your revocation (e.g. by e-mail).  

The legal basis for the examination of the contributions is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in improving the quality of our Internet presence and in giving you the opportunity to automatically publish your contributions published as part of deals on our website and/or to inform the deal partner that the conditions have been met.

The personal data collected will be deleted as soon as processing is no longer necessary. If the operator has to comply with legal retention periods for personal data, your personal data will not be deleted, but blocked until the expiry of the legal retention obligation (restriction of processing by appropriate blocking marking, Art. 4 No. 3 DS-GVO)

5. contact enquiries / contact possibility

If you contact us or an accommodation provider represented on the platform via contact form or e-mail, the data you provide will be used to process your enquiry. This data is necessary for processing and answering your enquiry - we cannot answer your enquiry without providing it. Your data will be deleted if your request has been answered conclusively and if there are no legal obligations to store the data to prevent deletion, e.g. in the case of any subsequent contract processing.

The legal basis for this processing is Art. 6 para. 1 lit. b) DSGVO insofar as your inquiry is connected with the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. As far as the forwarding of enquiries to the represented companies is concerned, our legitimate interest (Art. 6 para. 1 lit. f DSGVO) in the effective processing and forwarding of enquiries directed to third parties is the legal basis.

6. Newsletter

If you register for our free newsletter, the data requested from you for this purpose, i.e. your e-mail address and - optionally - your name and address, will be transmitted to us. At the same time, we store the IP address of the Internet connection from which you access our website as well as the date and time of your registration. As part of the subsequent registration process, we will obtain your consent to the sending of the newsletter, specifically describe the content and refer to this privacy statement. The date and time of DoubleOpt-In's consent will continue to be stored - the data collected will be used exclusively for the newsletter dispatch - it will therefore not be passed on to third parties.

The legal basis for this is Art. 6 Para. 1 lit. a) DSGVO.

You can revoke your consent to the sending of newsletters at any time with effect for the future in accordance with Art. 7 Para. 3 DSGVO. All you have to do is inform us of your revocation or click on the unsubscribe link contained in each newsletter.  

7. Cookies

    We use so-called cookies on our website.       If you as a registered user publish contributions via our platform, we can also publish them together with the evaluations of other users via Facebook and/or Instagram accounts. Only for single registered users visible contributions of you (chat messages) are not published or passed on under any circumstances.  

      If a plug-in from Facebook or Instagram is stored on one of the pages of our website that you visit, your Internet browser downloads a representation of the plug-in from the Facebook servers. For technical reasons, it is necessary for Facebook or Instagram to process your IP address. In addition, the date and time of your visit to our website are also recorded.

      If you are logged into Facebook when you visit our website, the information collected by the plug-in about your visit will be recognized by Facebook, stored and assigned to your Facebook user account, e.g. when you use the "Like" or "Like" button on Facebook.     2. Google Maps, Google Analytics und Google Fonts

      On the website and in the application, we use Google Analytics to analyse the usage behaviour of visitors and users. We also use Google Maps to display travel destinations and their locations and to create directions. In addition, we use Google Fonts to display external fonts.

      In order to enable the display of certain fonts on our website, a connection is established to the Google server in the USA when our website is accessed.

      If you call up the Google Maps component integrated into our Internet presence, Google stores a cookie on your terminal device via your Internet browser. Your user settings and data are processed in order to display our location and to create a route description. We cannot rule out the possibility that Google may use servers in the USA. The connection to Google established in this way enables Google to determine which website has sent your request and to which IP address the route description is to be sent.

      The legal basis is Art. 6 Para. 1 lit. f) DSGVO. Our legitimate interest lies in optimising the functionality and our Internet presence. The legal basis for the user analysis by Google Analytics is Art. 6 Para. 1 lit. f) DSGVO.

      Our legitimate interest lies in the analysis of the use for the optimisation of our website and the services offered, as well as in the use of our website for the optimisation of the services offered.

      When using the website and application, usage and user-related information such as IP address, location, time or frequency of the visit to our website and application is transferred to a Google server in the USA and stored there. 

       

      We use Google Anlaytics with an anonymization function so that the IP address is shortened on servers within the EU so that a unique identification is no longer possible. In addition, Google states that the IP address is not linked to any other available information.

       

      The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our site and the use of our application as well as activities there. Google may also use this data to provide other services.

    In addition, pursuant to Art. 21 DSGVO you may object to the future processing of the data relating to you, provided that this data is processed by us on the basis of Art. 6 para. 1 lit. f) DS-GVO (legitimate interest). In particular, it allows you to object at any time to data processing for the purpose of direct marketing.
